How Compensation Works in Catastrophic Injury Cases

Illinois uses the modified comparative fault rule in personal injury cases. According to state law, injured victims can't file a lawsuit to seek compensation if they are more at fault for the accident than the other person or party. For example, if you are found to be 51 percent or more at-fault for the accident, you can't recover damages.
